Who is responsible for processing your personal data?

INGENIOUS MEMBRANES S.L. is the RESPONSIBLE of the USER’s personal data and informs the USER that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD).

Why do we process your personal data?

To maintain a commercial relationship with the user. The intended operations for processing are:

• Sending commercial advertising communications via email, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that enables commercial communications. These communications will be made by the RESPONSIBLE and related to their products and services, or those of their collaborators or suppliers, with whom they have reached a promotion agreement. In this case, third parties will never have access to personal data.
• Conducting market research and statistical analysis.
• Processing orders, requests, responding to inquiries, or any type of request made by the USER through any of the contact forms available on the RESPONSIBLE’S website.
• Sending the online newsletter about news, offers, and promotions in our activity.

Why can we process your personal data?

Because the processing is legitimized by Article 6 of the GDPR as follows:

• With the USER’s consent: sending commercial communications and the newsletter.
• By legitimate interest of the RESPONSIBLE: conducting market research, statistical analysis, etc., and processing orders, requests, etc., at the USER’s request.

How long will we keep your personal data?

They will be kept no longer than necessary to maintain the purpose of the processing or as long as there are legal requirements that dictate their custody. When no longer necessary, they will be deleted with appropriate security measures to ensure the anonymization of the data or the total destruction of the data.

Who do we share your personal data with?

No personal data will be communicated to third parties unless there is a legal obligation or if necessary for the development and execution of the purposes of the processing, to our service providers related to communications, with whom the RESPONSIBLE has signed the confidentiality and data processor contracts required by current privacy regulations.

What are your rights?

The USER has the following rights:

• The right to withdraw consent at any time.
• The right of access, rectification, portability, and deletion of their data, and to restrict or oppose its processing.
• The right to file a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

Users, by marking the corresponding boxes and entering data in the fields, marked with an asterisk (*) in the contact form or provided in download forms, expressly and freely and unequivocally accept that their data is necessary for the provider to attend to their request, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the RESPONIBLE is truthful and is responsible for communicating any changes to them.

The RESPONSIBLE informs that all the data requested through the website are mandatory, as they are necessary to provide an optimal service to the USER. If not all the data are provided, it is not guaranteed that the information and services provided will be completely adjusted to their needs.

3. SECURITY MEASURES

In accordance with current regulations on personal data protection, the RESPONSIBLE is complying with all the provisions of the GDPR and the LOPDGDD for the processing of the personal data under their responsibility, and manifestly with the principles described in Article 5 of the GDPR, by which they are processed in a lawful, fair and transparent manner in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The RESPONSIBLE guarantees that they have implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD to protect the rights and freedoms of USERS and has communicated the appropriate information so that they can exercise them.
